Weedist Comment Sweepstakes Official Rules
No Purchase Required to Enter or Win.
1. Introduction. During the period beginning at 12:00 a.m. Pacific Time (“PT“), October 1, 2012 and will run until further notice (the “Promotion Period”) Weedist will offer a calendar monthly sweepstakes (“Sweepstakes“). The details for the Sweepstakes can be accessed by clicking on the Weedist website: http://www.weedist.com (the “Website“). For purposes of these Official Rules, this Sweepstakes is referred to as the “Weedist.com Comments Sweepstakes.” The Sponsor’s computer is the official time keeping device for this Sweepstakes.
2. Eligibility. The Weedist.com Comments Sweepstakes is open only to those who are legal residents of the 50 United States or the District of Columbia, who are 18 years of age or older at the time of entry. Employees and non-employee workers of Weedist, subsidiaries, and affiliates, prize providers, agents and agencies involved in the Sweepstakes, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such ineligible person, are not eligible. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law. To participate in the Sweepstakes, entrants must have access to the Internet and a valid verifiable email address.
3. Sponsor. The Sweepstakes is sponsored by Weedist (“Sponsor”), which is owned and operated by ForteFive LLC, 60 29th Street #520, San Francisco, CA 94110.
4. Agreement to Official Rules. By participating in the Weedist.com Comments Sweepstakes, entrant fully and unconditionally agrees to and accepts these Official Rules, the Website’s Terms of Use and the decisions of the Sponsor, which are final and binding in all matters related to the Weedist.com Comments Sweepstakes.
5. How to Enter:
5a. Submit Comments on the Website. Each comment submitted on the Website counts as 1 (one) entry in the Sweepstakes. Entrants are allowed to submit as many comment entries as they’d like. Each comment will count as a single submission into the Sweepstakes (i.e., if you have 20 non-disqualified comments in a given calendar month, your name will be placed 20 times into the Sweepstakes before a winner is selected for the calendar month).
Comment submissions are taken from the first calendar day of the month through the last calendar day of the month. Any comment submissions after the deadline will be eligible for the following calendar month’s drawing.
Sponsor reserves the right to disqualify, delete, reject, and/or otherwise remove any views, opinions and comments posted or part thereof that are considered a nuisance that include but are not limited to:
- potentially libelous (slanderous) wording of any kind
- potentially torturous (an act which is a civil wrong) in any way
- defamatory or abusive statements or comments
- obscene, excessively foul and/or vulgar language
- ethnically objectionable, racist, or otherwise hateful statements, remarks
- inappropriate sexual wording
- use of illegal material or material that infringes on the rights of others without prior permission
- completely off-topic material
- any remark or statement that you know to be confidential or sensitive or otherwise in breach of the law
- make false or misleading statements
- submissions considered to be spam
5b. Subscribe to Weedist.com’s Newsletter. Entrants subscribed to the Weedist.com newsletter (“Newsletter”) at the end of each calendar month will earn 2 (two) entries for that calendar month’s drawing (i.e., if you were subscribed to Newsletter as of 23:59:59 on October 31, your name would be placed 2 times into the Sweepstakes before a winner is selected for October.) Entrant will receive 2 entries for each calendar month drawing for as long as they are subscribed to Newsletter, even if entrant submits no comments in that calendar month. There is a limit of one Newsletter subscription per entrant for a maximum of two entries per calendar month. Any attempt by any entrant to obtain more than the stated maximum number of Newsletter entries by using multiple email addresses, identities, registrations and logins, or any other methods will void that participant’s entries and that participant may be disqualified from the Weedist.com Comments Sweepstakes and any of the Sponsor’s other promotions. 5c. For all Entries. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents (including, but not limited to, sweepstakes entry services) will void all entries by that entrant.
6. Drawings. The Sponsor will select the potential winner for the Sweepstakes each calendar month in a random drawing from all eligible entries received, within 7 days of each calendar month’s end. The potential winner will be notified by email. The odds of winning depend on the number of eligible entries received in the Sweepstakes.
7. Requirements of Potential Winners. Potential winners must continue to comply with the Official Rules and winning is contingent upon fulfilling all requirements. Potential Winners will be notified by e-mail. Potential winner has 72 hours from notification to respond and fulfill any such other requirements as determined by Sponsor to receive prize. If prize is not claimed within 72 hours the prize will be disqualified. In the event that a potential winner is disqualified for any reason, Sponsor may select an alternate winner in a random drawing from among all remaining eligible entries, up to 3 alternates, if time permits. If all potential alternate winners are disqualified for any prize, no further drawings will take place and that prize will not be awarded.
8. Prizes: By approximately the third of each calendar month, Sponsor will publish on Website the prize for Sweepstakes drawing at the end of the calendar month. A maximum of one prize per calendar month. No substitution, exchange or transfer of prize by winner. Prize is not redeemable for cash. Sponsor reserves the right to substitute any prize for one of equal or greater value. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Prizes are awarded without warranty of any kind from Weedist, express or implied, without limitation, except where this would be contrary to federal, state, provincial, or local laws or regulations. Sponsor will incur all costs associated with the initial shipping of the prize to the sweepstakes winner, with the shipping address and name provided. Any costs incurred beyond that are solely the responsibility of the winner.
9. Publicity. Except where prohibited, participation in the Sweepstakes constitutes entrant’s consent for the Sponsor and their respective designees, state of residence, and any comments, testimonials or other feedback related to any prize or entrant’s Sweepstakes experience, whether written or oral, for promotional purposes in any media without further consideration. Sponsor will not use entrant’s name or likeness for promotional purposes without written pre-approval.
10. General Conditions. In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but, not limited to, fraud, virus or other technical problems, the Sponsor may, in its sole discretion, either: (a) modify the Sweepstakes in a manner that best conforms to the spirit of these Official Rules without suspending it; (b) suspend the Sweepstakes to address the impairment and then resume Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (c) cancel the Sweepstakes and award the prize in a random drawing from among all eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion, or in an unsportsmanlike or disruptive manner, from the Sweepstakes or any other promotions run by the Sponsor. Any attempt by any person to undermine the legitimate operation of any part of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
12. Release and Limitations of Liability. Except where prohibited, by participating in the Sweepstakes, entrants agree to release and hold harmless Weedist, owned and operated by ForteFive LLC, and their respective parents, subsidiaries, affiliates, promotional partners, prize partners,, providers and their respective agents and agencies, officers, directors, and employees (the “Released Parties“) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Sweepstakes or the processing of entries; (e) late, lost, or undeliverable mail or email; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages (other than for actual out-of-pocket expenses) and any and all rights to have damages multiplied or otherwise increased. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes; provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded.
13. Disputes. Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California or the appropriate California State Court located in San Francisco County, California; and (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
14. Weedist.com Comments Sweepstakes Results. For a list of the confirmed winners, send an email with the Subject Line: “Weedist.com Comments Sweepstakes Win List Request” to winlistrequests@weedist.com. Responses will provide a maximum of the previous six monthly winners from the date of the request. Sponsor will not disclose legal names of winners without the written pre-approval of each respective winner; in absence of written permission, Sponsor will display each winner’s initials, city and state of residence (i.e. J.W., Menlo Park, CA).
